Welcome to ittjeneste OÜ ("Company," "we," "our," "us"). These Terms of Service ("Terms") outline the general conditions for accessing and using our website building services ("Services"). By accessing or using our Services, you agree to these Terms.
However, please note that our services will only begin once you, as a potential client, have contacted ittjeneste OÜ and established a binding contract tailored specifically to your needs. This binding contract will detail the specific terms of our agreement and will take precedence over these general Terms of Service.
We provide professional website building services, which include the design, development, and maintenance of websites for our clients ("Client," "you," "your"). Our Services also encompass email services and hosting websites on external services for clients.
Services will commence only after a potential client contacts ittjeneste OÜ and a binding contract, tailored to the client's specific needs, is established. This contract will outline the scope of work, payment terms, and any other relevant details. The contract will take precedence over these general Terms of Service.
Upon agreement to use our Services, an initial setup fee will be determined and outlined in the binding contract. This fee covers initial consultation, design, and development of your website.
Billing is processed through the Stripe payment service. Clients will be billed according to the work progress and the terms specified in the contract. Payments will be required at various stages of the project as outlined in the contract.
After the website is completed, clients may enter into a maintenance and hosting agreement. These services will be billed monthly through Stripe, as specified in the contract.
Payments are processed through Stripe. By entering into a contract with us, you agree to provide accurate and complete payment information and authorize us to charge your provided payment method according to the terms of the contract.
If we do not receive payment from you by the due date specified in the contract, we reserve the right to suspend or terminate your access to the Services.
You may terminate your contract at any time by contacting us at contact@ittjeneste.com. Termination terms and any applicable fees will be outlined in your specific contract.
Refunds will be handled according to the terms specified in the contract. Generally, payments made are non-refundable unless otherwise stated in the contract.
You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not use the Services in any way that violates any applicable federal, state, local, or international law or regulation.
All content, designs, and code created by us for your website remain our intellectual property until full payment is received as per the contract. Upon full payment, you are granted a non-exclusive, non-transferable license to use the content, designs, and code for your website. Please note that the website may include third-party elements that are subject to their own licenses, and you must abide by the terms of those licenses as well.
Prices are reviewed annually or as specified in the contract. We will make every effort to notify you in writing of any price increases or changes to the pricing structure or services at least 30 (thirty) days before the payment due date.
We reserve the right to terminate the Services with a three-month notice period if you do not agree to the price adjustments suggested by ittjeneste OÜ.
Upon termination, you may request an exit setup for a fee specified in the contract. This setup includes all necessary adjustments to make your website independent of ittjeneste OÜ. We will provide instructions on how to manage the website and services yourself.
If you wish to terminate your contract, you must provide notice that will take effect at the start of the next billing period. You can request an exit setup, for which you will be charged, to make your website independent of ittjeneste OÜ. If you do not opt for the exit setup, you will lose access to the Service permanently. The specific details regarding termination will be outlined in the binding contract.
To the fullest extent permitted by law, in no event will ittjeneste OÜ, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Services.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. These Terms of Service will be overwritten by the detailed contract between the client and the company.
These Terms shall be governed and construed in accordance with the laws of Estonia, without regard to its conflict of law provisions.
